A proposal issued today by the U.S. Food and Drug Administration, if finalized, would effectively make trans fat in the food supply a thing of the past. The Gazette asked Professor Walter Willett, chair of the Department of Nutrition at the School of Public Health, to discuss the potential impact of the ruling, in policy and health. GAZETTE: What exactly has the FDA done today? Is there a chance the ban could be derailed during public comment?WILLETT: The FDA announced a determination that partially hydrogenated fats are no longer “generally regarded as safe” (GRAS). This requires a comment period before implementation, but I don’t think any reasonable person could now claim that they are regarded as safe because every major organization that has looked at this issue has concluded that trans fats (produced by partial hydrogenation) are harmful. Implementation of this determination will effectively eliminate trans fats due to partial hydrogenation from our food supply.GAZETTE: Can you talk a little about why this is so important, in terms of public health and how many lives may be saved annually?WILLETT: Even though about 75 percent of trans fats have been removed from our food supply already, millions of Americans are still consuming amounts that are harmful. The CDC has estimated that about 7,000 premature deaths could be avoided by eliminating the remaining trans fats. Other benefits are likely, including reductions in rates of heart attacks, diabetes, and obesity.GAZETTE: Have most restaurants and food manufacturers already eliminated the use of trans fats? Do you expect any really meaningful resistance to the proposal?WILLETT: Yes, most but not all restaurants and food manufacturers have already eliminated trans fats. I don’t think there will be substantial resistance; it will probably become difficult to obtain trans fat because producers are likely to eliminate it.GAZETTE: So this seems like a pretty big advance for public health advocates. Is there a similar victory over the last 10 or 20 years to compare it with?WILLETT: The earlier steps in reducing trans fat were also important victories, including requiring trans fat on food labels and banning of trans fat from restaurants, which was done at city and state levels. We have had some important victories on smoking reduction, but again this has been mainly at city and state levels.GAZETTE: Any words of caution? Do you worry that after a major change like this there’s any risk of complacency in other areas of concern? For example, the person who says, “Well now that I don’t have to worry about trans fats, I can have the extra portion.”WILLETT: I don’t worry much about complacency due to trans fat elimination. March 15, 2006 Regular News Board files contingency fee waiver proposal Gary Blankenship Senior Editor Clients could, in writing and after full disclosure, waive their constitutional right to limit attorneys’ contingency fees in medical malpractice cases under a proposed Bar rule being submitted to the Supreme Court. The rule would allow, but not require, a judge to review the waiver.At its Tallahassee meeting February 17, the Bar Board of Governors, responding to an order from the high court, approved the proposed contingency fee rule drafted by a special committee. The rule now has been sent to the court for its consideration. (See Notice, page 30)The court ordered the Bar to draft the rule after it held oral arguments November 30 on a petition from 54 Bar members, led by former Chief Justice Stephen Grimes. Those Bar members asked the court to amend the Bar’s contingency fee rule to reflect Amendment 3 approved by voters in 2004.That amendment limits contingency fees in medical malpractice cases to 30 percent of the first $250,000 awarded, exclusive of costs, and to 10 percent on higher awards. Some attorneys responded by getting their clients to waive their constitutional right to the lower fee.The court ordered the Bar to prepare a rule that would address the waiver, the necessity for fully informing clients of their rights under Amendment 3, their right to consult with another attorney, and a requirement that the waiver be in writing. The court also asked the Bar to consider whether a judge should review the waiver.Under current Bar rules, exceeding the contingency fee limit requires a judge’s review and approval with a certification the client otherwise would be unable to obtain his or her counsel of choice.“The [proposed] rule requires that the client initial that he or she understands the implication of signing the form and in addition the form requires that the waiver be under oath,” said former Supreme Court Chief Justice Major B. Harding, who chaired the Bar’s Special Committee on Amendment 3.The committee also voted to require a judicial review only if the proposed fee exceeds the presumed maximum fees in the current rules. “Some of the members of the committee in discussion felt the current requirement of requiring the court to approve fees beyond the rule is an exercise in futility” because the waiver is almost always approved, Harding said.Some committee members wanted to recommend the Bar look at doing away with the existing waiver requirement, but Harding said that was beyond the scope of the panel.William Hahn, another special committee member and president of the Florida Chapter of the American Board of Trial Advocates, said members were concerned about delays in getting a judge’s approval.“In med mal cases, before you can go to court there is a procedure that must be followed,” Hahn said. “All they [committee members] could envision was further delays in getting to the courthouse” by requiring judicial review of the waiver.“We can get a hearing sometimes in a month, sometimes it takes three months,” he added. “All the judges I spoke with and many of the lawyers I spoke with felt that having a hearing on this was something they didn’t see the need for.”Hahn said the court seemed to express two concerns in its order to the Bar. One was to recognize the language of Amendment 3 and secondly that there be a set procedure for discussing the language with clients, informing them of their rights including that they can consult another attorney, and getting a signed waiver.“With all the swearing under oath and all the highlighted areas, we think this accomplishes the goal that everyone understands what they are signing,” Hahn said.The board approved the special committee’s proposed rule 38-1.Bar President Alan Bookman praised the work of the special committee, noting its members included trial lawyers, FLABOTA, defense lawyers, and others.The proposed rule change sets out the procedure for informing clients about the provisions of Amendment 3 and provides the waiver form that must be used.It also adds this language to the comment for Rule 4-1.5: “Rule 4-1.5(f)(4)(B)(iii) is added to acknowledge the provisions of Article 1, Section 26, Florida Constitution, and to create an affirmative obligation on the part of any attorney contemplating a contingency fee contract to notify a potential client with a medical liability claim of the limitations provided in that constitutional provision. This addition to the rule is adopted prior to any judicial interpretation of the meaning or scope of the constitutional provision and this rule is not intended to make any substantive interpretation of the meaning or scope of that provision. The rule also provides that a client who wishes to waive the rights of the constitutional provision, as those rights may relate to attorneys’ fees, must do so in the form contained in the rule.” Board files contingency fee waiver proposal

HINOLAN BY DOMINIQUE GABRIEL BAÑAGABACOLOD City – Mayor Richard Jaojoco of Toboso, Negros Occidental has defended one of his barangay captains in hot water over the distribution of cash aid under the government’s Social Amelioration Program (SAP).Jaojoco believes the case against village head Romeo Sultan of Barangay Salamanca was “politically motivated,” and he would not bow down to the political powers in the 1st District.Sultan was charged by the Criminal Investigation and Detection Group (CIDG) before the Provincial Prosecutor’s Office for violation of Republic Act (RA) 3019 (Anti-Graft and Corrupt Practices Act) and RA 11469 (Bayanihan to Heal as One Act).A separate administrative case for Violation of RA 6713 (Code of Ethical Standard of Public Official) is also set to be filed at the Office of the Ombudsman upon resumption of its services.Lieutenant Colonel Anthony Gantang, head of the CIDG-Negros Occidental, said some residents of the barangays went to their office to complain not being included in the list of beneficiaries to receive the cash assistance from the national government.However, Jaojoco denied the complainants and CIDG’s claim.The mayor pointed out that in his municipality alone “there are 3,000- 4,000 families who did not receive the first tranche of the SAP despite being qualified.”“The regional director of the Department of Social Services and Development actually wrote me a letter explaining that they don’t have enough funds for all legitimate beneficiaries,” Jaojoco said.He said the barangay captain “has nothing to do about it.”“These police from the Negros Occidental Provincial Police Office are looking for a political patron which they found in the 1st District,” he added.In May, the CIDG also filed similar charges against 19 barangay officials in Western Visayas over alleged anomalies in the distribution of SAP./PN

Could scientists cure ageing, allowing humans to live Old Testament lifespans? A contest is on to fix the “chronic disease” of growing old.Jacob lived to 147. Noah lived to 950. Methuselah lived to 969. Why not? A new “Palo Alto Longevity Prize” is attracting teams to “hack aging [sic], cheat death” says an intriguing article on Medical Xpress. It raises questions about genetics, health, economics and the meaning of life.One year after Google created a company named Calico with the goal of extending human life, Menlo Park investor and Stanford-trained radiologist Joon Yun has launched a $1 million science competition with the lofty aim of “curing” the disease more commonly known as aging [sic].While Calico’s plan remains largely opaque, Yun has laid out specific criteria for the 11 teams that have already signed up to compete for the Palo Alto Longevity Prize, which focuses on improving “homeostatic capacity,” or the ability of an organism to bounce back to normal in the face of stress.And what is ageing? It’s a treatable condition caused by “Inflammation, stress (and) chronic disease,” according to one stem cell specialist. Yun is urgent about this contest, saying that “every day 100,000 people die unnecessarily of age-related illness.” The contest will start with test mammals and eventually move on to human trials.One of the contestants, Joao Pedro de Magalhaes of the University of Liverpool, shared some of his reasons for thinking ageing is mutable on The Conversation. He points to some birds that stay healthy into their senior years, to tortoises that can live over a century, and to naked mole rats, who are extremely resistant to cancer. Work on extending lifespan is worthwhile because “it has been calculated that slowing down the process of ageing by just seven years could cut in half the instances of age-related diseases at every single age,” he says. “This would have a massive impact on the human lifespan, and on human health.”Won’t longer life spans hurt the economy? What about overpopulation, and drains on the earth’s resources? Those concerns are addressed and dismissed by advocates, who believe innovation can solve them. Sonia Arrison says,Arrison, a Palo Alto-based author and teacher, claims that increasing the healthy life span, by extending the sweet spot of adulthood that combines vigor with the wisdom of experience, will give the world’s best minds more time to innovate solutions to humanity’s problems.How could life extension be achieved? Two methods are mentioned: stem cells and genetic engineering. Doris Taylor thinks the trio of inflammation, stress and chronic disease can be addressed with stem cells. Yun thinks hacking the “source code” (the human genome) is another approach.“Ultimately, I think we’ll crack the age code and we’ll hack aging [sic],” Yun announced. “And if we do, not only will health care be transformed, but humanity. At that point we’ll have unlocked human capacity.“Scientists know that telomeres—the end caps on chromosomes—shrink each time a cell divides. When gone, the cell dies. Some cells use the telomerase enzyme to replace lost segments of telomeres. Learning to control that process might allow cells to reproduce an unlimited number of times. Significant life extension, though, is conceivable. What would you do with 100, 150, or 200 healthy years of life? As has occurred throughout history, some would use their extra time for good, others for evil. For the ungrateful, even 969 years would not be enough.When Moses spoke of the “threescore and ten” years of human existence in Psalm 90:10, he wasn’t speaking of a divine mandate; he was just mentioning an observable fact. God told Adam and Eve at the Fall that they would surely die—and they did—but he didn’t say how soon. Most of the antediluvian patriarchs lived over 800 or 900 years. To God, for which a thousand years is like a day (II Peter 3:8) because He is unaffected by time, humans died quickly after sinning. In mercy, the Creator gave sinners enough time to consider repenting and believing in His provision for their salvation.In recent centuries, human life spans were much shorter than ours: 40 years on average (still the case in some countries), and as low as 25 years a millennium ago. Few were those reaching into their 60s to 80s as is commonplace today. Many in that age bracket are probably watching the clock, even if their lives have been fulfilling. When death is at the door, all that time is going to look like a “vapor that appears for a moment, then vanishes away” (James 4:13-15).Is it moral to try to defeat ageing? Why not? It’s like treating any other human malady. We know we will never live forever, but if you or I could get a few more productive years of vigor out of our lives, many of us would probably want that. We would not want to see terrorists and anarchists with that much time, though. It’s frightening to consider the evil that men like Hitler or Stalin would do with 200 years of vigor. Just before the Flood, the world was filled with violence (Genesis 6:11) from people with long life spans: “And God saw that the wickedness of man was great in the earth, and that every imagination of the thoughts of his heart was only evil continually” (v. 5). God is merciful to spare us from those kinds of possibilities now.When dementia or pain becomes our lot, we might wish for nature to take its course. But many a genius, like Mozart, Pascal and Maxwell, died young. Imagine the good that some could have done with more time. In God’s wisdom, with His foreknowledge, He may take some home what seems prematurely to us, for His purposes. Perhaps He knows their work on earth is done (could the world handle 200 Handel oratorios?) Perhaps He knows some would fall into sin if given more time.Christians believe in a sovereign God who numbers our days and gives us the allotment we need, even if “man knows not his time.” This is not fatalism. It does not rule out seeking to extend life with good healthcare. In fact, doing good to others’ physical needs and being responsible with our bodies are virtues. The attitude of these Palo Alto contestants is surely better than the “War on Humans” mentality of others. There’s nothing unethical about trying to defeat ageing. In the end, though, we must realize that fellowship with our Creator is our highest good, in this life or next. That is how best to “number our days, that we may apply our hearts unto wisdom.” Jesus lived a short life by human standards. He felt urgency to complete His work in the day, “for the night is coming, when no man can work” (John 9:4), and His work was entirely sacrificial for our good. Christ followers have confidence of a beautiful life without sin, pain and death, but now is the time to make other Christ followers and teach them all that the Lord commanded (Matthew 28:19-20). Now is the time to pray, “Thy will be done, on earth as it is in heaven” (Matthew 6:10). So get busy! You may not have much time left. What on earth are you doing for heaven’s sake? Make sure that each team contains at least one member who’s well-skilled and experienced at data analytics.The data-driven journey requires retraining of the job force in analytical skills as well as in mindset, so that the employees can understand how data-driven decisions are made and how they contribute to the growth and performance of the company. Nagaland Deputy Chief Minister Y. Patton has said that the signing of the Naga peace accord will take a few more days and that the Naga groups, including the NSCN(IM), will keep negotiating for a separate constitution and flag.Mr. Patton, who also holding the Home portfolio, said Chief Minister Neiphiu Rio and he were seeking an appointment with Prime Minister Narendra Modi and Union Home Minister Amit Shah to get clarity on their future role.“The signing of the final Naga agreement will not take much time as major groups are on board. We want to know what will be the role of the present government after the accord is sealed. This is the issue we want to discuss with the Prime Minister and the Home Minister,” Mr. Patton, who reached Delhi on Friday, told The Hindu.Mr. Rio is also in Delhi.Mr. Patton said they would have to speak to the neighbouring States of Assam, Manipur and Arunachal Pradesh amid the possible creation of autonomous councils in Naga-populated areas.“Now they (Centre) will have to tell us the truth, they cannot hide from us any more. The Governor is having discussions with NNPGs and NSCN-IM; things are almost settled but I cannot say anything before it is finalised,” he said.Manipur has been on edge as the peace agreement reaches its final stages.Naga interlocutor R.N. Ravi, who is also Nagaland’s Governor, is holding final discussions with National Socialist Council of Nagaland (Isak-Muivah) and Naga National Political Groups (NNPG) in the last leg of meetings in Delhi.Lt. Gen. (retd) Shokin Chauhan, chairman of the ceasefire monitoring group, said the situation in Nagaland was peaceful and he was deputed to speak to the NSCN-IM to sort out any apprehension they might have.“I spoke to them (NSCN-IM) on the Centre’s behalf. Most of them were worried about their safety, like what will happen to their cadres, weapons etc after the agreement is signed. I was available to listen to them,” Lt. Gen. (retd) Chauhan said. The armed group, which signed a ceasefire in 1997, has been operating from a camp in Hebron in Nagaland.NSCN-IM statementOn October 31, the NSCN-IM released a statement that the negotiating team led by T. Muivah, has extended his gratitude to various civil society groups including the church and that “God has answered your (Naga people) prayers and they are now able to take positive steps towards a final solution.”Earlier, the Centre had accused the NSCN-IM with which it signed a framework agreement to find a solution to the decades-old Naga issue in 2015 of delaying the talks. However, on Thursday, Mr. Ravi said the armed group was back on board and the final discussions were underway.The NSCN-IM has been fighting for ‘Greater Nagaland’ or Nagalim — it wants to extend Nagaland’s borders by including Naga-dominated areas in neighbouring Assam, Manipur and Arunachal Pradesh — to unite 1.2 million Nagas. The Centre has however, ruled out any disintegration of the States of Assam, Arunachal Pradesh and Manipur in order to merge the Naga-inhabited areas with the existing State of Nagaland.The NNPG in a statement had claimed that Centre has “endorsed the usage of Naga emblem/flag specifically for cultural identity within Naga homeland.”
